About the Book

This is the 51st report from the Committee of Public Accounts, of the 2007-08 session (HCP 601), and examines the role of the Revenue and Customs Prosecutions Office. The Office was established on the 1st April 2005, with the aim of prosecuting offences for the former HM Customs and Excise and Inland Revenue (now HM Revenue and Customs) and also from April 2006, for the Serious Organised Crime Agency. The Office is headed by a Director and is one of the Law Officers' Departments. An NAO report (HCP 273, session 2006-07, ISBN 9780102944587) highlighted shortcomings in the internal control system of the Office, issuing a qualified audit opinion on the Office's Resource Account for 2005-06. The weaknesses highlighted by the NAO were rectified, but for the first year and a half the Office's operations were not fully functioning. Failings arose, because the finance team was under-resourced and lacked experience, there was understaffing in the human resources section, and the Office lacked basic finance, procurement and human resources procedures. Further, the Director lacked the necessary support, training and experience to identify and mitigate risks. For the Committee, three such risks bring into question the training and support provided to the Accounting Officer by HM Treasury. Firstly, the Department did not inherit adequate records of counsel fees outstanding from earlier years. Secondly, a senior member of staff awarded consultancy contracts totalling £98,000 to his wife without due regard to the proper stewardship of public funds. The individual was cleared by an independent disciplinary tribunal of dishonesty, but was subsequently dismissed for gross misconduct. Thirdly, the Department awarded a consultancy contract without seeking the Treasury's agreement in advance to make payment. This report examines the events that led to a qualified audit opinion, the measures taken to address shortcomings and the lessons learned.
