This book examines the complex relationship between Temporary Protected Status (TPS), legal syndrome, and immigrant mental health, arguing that prolonged legal uncertainty combined with shifting political climates can have profound psychological effects on migrants (Menjívar & Abrego, 2012). Legal syndrome is defined here as the cumulative stress and trauma caused by navigating lengthy, uncertain, and bureaucratic legal processes, particularly in immigration contexts.
The study adopts a comparative approach, evaluating immigration systems and humanitarian protections in America, Europe, and Asia (Portes & Rumbaut, 2014). This perspective reveals that migrants in certain European countries often experience more robust social safety nets and mental health support than in the U.S., while Asian systems vary widely depending on geopolitical priorities and economic needs.
A central theme is how capitalism and systemic racism shape public discourse, access to resources, and policy implementation (Berry, 2006). Immigrants who are humanitarian beneficiaries - including refugees and asylum seekers - frequently encounter structural prejudice and economic exclusion, reinforcing social marginalization.
The book traces immigrant experiences under multiple U.S. administrations:
Carter and Clinton eras emphasized diplomacy and gradual immigration system reforms.
Bush (43) and Obama maintained enforcement but introduced selective relief programs like DACA.
Trump adopted aggressive deportation measures, tightened TPS renewal policies, and heightened anti-immigrant rhetoric, correlating with spikes in anxiety, depression, and community distress (Zong & Batalova, 2018).
Biden has attempted policy reversals, but bureaucratic delays and geopolitical pressures remain influential.
Economic factors such as inflation and unemployment exacerbate immigrant stress levels and hinder long-term integration (Massey & Pren, 2012). Geopolitical tensions - including U.S. attempts or discussions of intervention in Venezuela, Cuba, Haiti, Nigeria, and Iran - often directly influence immigration policy by framing certain groups as security threats (De Genova, 2010).
The role of security and intelligence agencies ("secret services") in immigration enforcement is scrutinized, along with presidential pardons and political scandals ranging from impeachment proceedings to high-profile criminal cases. These political and judicial events can indirectly affect TPS policy implementation and immigrant perceptions of safety.
Finally, this work contextualizes TPS and immigration within broader debates on globalization, sovereignty, and humanitarian responsibility, offering policy recommendations that address mental health impacts, economic inclusion, and legal reforms.
