In recent years, the European Commission has conducted an almost complete overhaul of State aid control in the European Union (EU). The State Aid Modernization (SAM) initiative has engendered new secondary legislation, as well as new guidelines covering practically all areas of State aid control, including both horizontal and sector-specific rules. Notable in these developments is an increasingly refined economic approach, both in the design of the rules and in the assessment of individual cases. This book, first of a kind in its in-depth analysis of the current legal and economic principles of EU State aid control, thoroughly explores the main rationales of State aid, the main concerns and the various trade-offs that underlie the rules and the decisions ultimately taken by the Commission and the Courts. The first part of the book covers the various elements of the notion of State aid, including the hotly disputed conditions of economic advantage and selectivity. Its second part covers the compatibility of aid measures under horizontal rules across industry sectors, including an assessment of the efficiency of the General Block Exemption Regulation and of the new rules on ex post evaluation. The third part deals with the application of State aid rules in specific sectors such as infrastructure, broadband, energy and banking. Distinguished experts - including lawyers, economists, academics, and officials of the European Commission and of Member State authorities - share their legal and economic experience, insight, and critique of EU State aid control as it stands. As a critical assessment of the current status of EU State aid control from both legal and economic perspectives, and as an authoritative guide through its complexities and pitfalls, this book will be of immeasurable value, now and in the coming years, to all stakeholders required to understand, interpret and apply the rules under the new regime of State aid control. Philipp Werner is a Partner in Jones Day's Brussels office. He has extensive experience in the area of State aid and advises public and private companies on privatization, restructuring, and investment aid. Vincent Verouden is a Director in E.CA Economics' Brussels office and a former Deputy Chief Economist at the European Commission. In this previous capacity, he was deeply involved in the various reform proposals in the context of the SAM programme.

About the Author :
Philipp Werner is a German qualified lawyer (Rechtsanwalt) and Partner in Jones Day's Brussels office. His practice focuses on German and European competition law. Philipp has extensive experience in the area of State aid and advises public and private companies, in particular, on privatization, restructuring, and investment aid. He also regularly appears before the EU and German courts. His clients include companies in the telecom, retail, consumer goods, chemical, infrastructure, and health care sectors. Philipp received his law degrees in 2000 from Oberlandesgericht Cologne and in 2005 from Kammergericht Berlin. He also holds a Master of Philosophy from the University of Bonn, a Master of Law degree from the University of Cambridge, and a Postgraduate Diploma in Economics for Competition Law from King's College London. Philipp was recognized by Global Competition Review as one of the world's leading competition lawyers under the age of 40 (2012) and also regularly appears in other publications such as Chambers, Who's Who Legal, and JUVE. He has authored numerous publications and articles on EU and German competition and State aid law. He is also a frequent speaker on antitrust, merger control, and State aid topics. Dr Vincent Verouden is a Director at the Brussels office of E.CA Economics. Until October 2014, he worked at DG Competition of the European Commission, in the last two years (2012-2014) as Deputy Chief Economist. Vincent, a Dutch national, joined DG Competition in January 2000. Until 2004, he worked in the Commission's Merger Task Force (MTF), where he was involved in the review of mergers and acquisitions across a broad range of sectors. He was also one of the authors of the Horizontal Merger Guidelines (published in 2004). Subsequently, Vincent worked for DG Competition's Chief Economist Team (CET), notably in the area of state aid control, where he contributed to the economic analysis of individual cases as well as to the development of state aid policy (e.g. State Aid Action Plan). From 2012 to 2014, he was deeply involved in the various reform proposals in the context of the Commission's State Aid Modernisation (SAM) programme. During his time at the CET, he further had key roles in the Non-Horizontal Merger Guidelines (2008) and in the Commission's sector inquiry in the pharmaceutical sector (2008-2009). His current consulting activities span the fields of antitrust, merger control and state aid control. Vincent is an extramural fellow at TILEC (Tilburg Law and Economics Center, Tilburg University) and a faculty member of the Brussels School of Competition (BSC).
