Die aktuellen Migrations- und Fluchtbewegungen haben in den letzten Jahren für die Mitgliedstaaten der Europäischen Union und für die Union selbst nicht nur politisch brisante Themen aufgeworfen, sondern es wurden auch auf den verschiedenen Ebenen des nationalen Rechts, des Europarechts und des Völkerrechts vielschichtige und komplexe juristische Diskussionen geführt. Daher wurden im Rahmen der elften Tagung der Societas Iuris Publici Europaei (SIPE) die Bedeutung von Migration als neue Herausforderung für Europa, für die Staatssouveränität und für den sozialen Rechtsstaat ausgelotet. Diese vielgestaltigen und komplizierten Fragen wurden zwei Tage lang von Fachleuten aus Theorie und Praxis, namhaften Juristen, Wissenschaftlern und Richtern aus ganz Europa in Bukarest lebhaft diskutiert. Der erste Schwerpunkt befasste sich mit der „Bewältigung der Migration durch Europa und das Recht“, der zweite Schwerpunkt bezog sich auf den „Schutz und Integration von Migranten im Recht der EU, der EMRK und der Mitgliedstaaten“. Bei beiden Themenkomplexen stand die Sicht derjenigen europäischen und nationalen Akteure im Mittelpunkt, die für die Bewältigung der Migration und den Schutz der Migranten die Verantwortung tragen. Die Tagung endete mit einer der Brisanz des Gegenstands entsprechend lebhaften Podiumsdiskussion, die Fragen hinsichtlich Herausforderungen durch Migration für das europäische öffentliche Recht zum Gegenstand hatte. Der Band enthält die schriftliche, überarbeitete Fassung der in Bukarest gehaltenen Referate zusammen mit den Beiträgen aus dem „Atelier Junger Wissenschaftler“. Die Referate sind in der beim Vortrag jeweils verwendeten Sprache – stets eine der drei „offiziellen“ SIPE‑Sprachen, d.h. deutsch, englisch und französisch – abgedruckt.
