Facharbeit (Schule) aus dem Jahr 2014 im Fachbereich Geschichte Deutschlands - Nachkriegszeit, Kalter Krieg, Note: 2,5, Sprache: Deutsch, Abstract: In meiner Hausarbeit behandele ich das Grundgesetz mit der zu untersuchenden Fragestellung, ob es ein Diktat der Westmächte (Alliierten) war beziehungsweise ist. Das Grundgesetz regelt seit dem 23.Mai 1949 die politische und religiöse Grundordnung der Bundesrepublik Deutschland. Das verfassungsgebende Grundgesetz wird auch als Abwehrrechte für die Bürger gegen den Staat verstanden und sichert individuelle Freiheiten und ermöglicht eine Wertordnung, die durch Objektivität überzeugt. Falls es doch zu Änderungen kommen sollte, ist dies nur durch die Zustimmung des Bundestages aber auch dem Bundesrates möglich (mit zwei-drittel Mehrheit). Insgesamt besteht das Grundgesetz aus 146 Artikeln, denn neben Grundrechten, sind auch die Institutionen Bundestag, Bundesrat oder wichtige Ämter wie zum Beispiel der Bundespräsident ausgeführt. Durch diese Artikel steht das Grundgesetz über allen anderen deutschen Rechtsnormen. Es ermöglicht die grundlegenden staatlichen System-und Wertentscheidungen in unserer Gesellschaft. Schon am offiziellen Titel "Grundgesetz für die Bundesrepublik Deutschland" erkennt man, dass es sich um ein rein nationale und einheitliche Verfassung handelt. Jedoch gibt es in den einzelnen Bundesländern verschiedene Landesverfassungen. Darin werden die eigenen Parlamente, Regierungen, Gerichte und vor allem die eigene Staatsgewalt ausgeführt und dargestellt. Diese genannte Institutionen müssen aber den in Artikel 28 I Grundsätzen des republikanischen, demokratischen und sozialen Rechtstaates im Sinne des Grundgesetzes entsprechen. Die in Artikel 31 genannte Normenhierachie, die besagt, dass das Bundesrecht Landesrecht bricht, grenzt aber wieder die Macht und Souveränität der einzelnen Bundesländer ein.
