Masterarbeit aus dem Jahr 2010 im Fachbereich Philosophie - Praktische (Ethik, Ästhetik, Kultur, Natur, Recht, ...), Note: 1,5, Humboldt-Universität zu Berlin (Philosophische Fakultät 1), Sprache: Deutsch, Abstract: Der Partisan ist ein Verkünder des aufkommenden Ausnahmezustandes. Als ein solcher kann auch der Jurist und politische Philosoph Carl Schmitt verstanden werden, der den Partisan als Figur einer eigenen Theorie wertschätzte. Diese Arbeit setzt sich mit Schmitts "Theorie des Partisanen" auseinander und wird analysieren, warum Carl Schmitt dieses Werk 1962 schrieb, welche Intention hinter seiner Theoriebildung stand und wie sich diese in Verbindung mit seinem Gesamtwerk sinnstiftend in der heutigen Zeit wiederfindet. Hierfür soll die Person Carl Schmitt als auch seine Werke sowohl historisch beleuchtet als auch theoretisch untersucht werden. Dabei werden Punkte wie seine Freund-Feind-Distinktion, die Definition des Politischen und des Ausnahmezustandes, sowie die Beschreibung des Charakters des Partisan in den Vordergrund gestellt. Für diese Analyse wird in einem Exkurs auch auf Schmitts Nomosphilosophie mit den Begriffen der Legalität und Legitimität eingegangen, um die Basis des Rechts zu klären. Hierbei erfolgt ebenfalls die Betrachtung des Völkerrechtes des Jus Publicum Europaeum, die daraus folgende Kriegshegung und Exklusion des Partisanen aus dem Kriegsrecht. Zu der detaillierten Untersuchung des Partisan gehören ebenfalls die Beschreibung seiner Gefährdungsquellen: die Technisierung und die Absolutwerdung der Feindschaft und damit der Kampftechnik. Der Partisan stellt für Schmitt in seiner Theorie der konventionellen, wirklichen und absoluten Feindschaft den Ausdruck der wirklichen Feindschaft dar, solange er sich der Instrumentalisierung durch Ideologie oder interessierte Dritte erwehren kann.
