Das Geschaftsbankensystem ist in Deutschland in Universalbanken und Spezialbanken unterteilt. Unter den Universalbanken gibt es private - und offentlich - rechtliche Geschaftsbanken, die alle wichtigen Bankleistungen anbieten.1 Die Universalbanken werden in verschiedenen Rechtsformen gefuhrt, wobei die Formen der AG, der eG, der Sparkasse und der Kommanditgesellschaft auf Aktien (KGaA) vorherrschend sind. Je nach der Rechtsform mussen verschiedene Vorschriften fur den Jahresabschluss einer Bank angewendet werden. Die Bilanzierung des Eigenkapitals ist dabei ein wichtiger Bestandteil der Bilanz, um die Kennzahlen der Eigenkapitalquote und der Eigenkapitalrentabilitat berechnen zu konnen und somit die Wettbewerbsposition der Banken untereinander darzustellen. Der unterschiedliche Ausweis dieses Bilanzpostens hangt von der rechtlichen Ausgestaltung der Bank ab und ob die Rechnungslegungsvorschriften des HGB oder der IAS / IFRS angewendet werden. Das Eigenkapital der Sparkasse besteht oft nur aus einer Sicherheitsrucklage. Im Gegensatz dazu ist im IFRS Abschluss einer Bank als AG eine hoch komplexe Eigenkapitalgliederung zu finden. Zunachst geht es in Kapital 2.1 um die Definition, Aufgaben und Funktion des Eigenkapitals bei Banken. Die beiden folgenden Kapiteln 2.2 und 2.3 erlautern die Funktion des Eigenkapitals als haftendes Eigenkapital, indem die Angemessenheit der Eigenkapitalausstattung unter Basel I und die neuen Vorschriften nach Basel II 2 beschrieben werden. Die Grosse des bilanziellen Eigenkapitals nach dem HGB und den IAS / IFRS wird in den Abschnitten 2.4 und 2.5 dargelegt. Auf die Rechnungslegung nach den US - GAAP wird nicht eingegangen, bislang bilanziert nur die Deutsche Bank nach diesen Vorschriften. Im dritten Kapital werden die einzelnen, wichtigsten Rechtsformen von Banken vorgestellt und der entsprechende Eigenkapitalausweis wird theoretisch und praktisch dargestellt. Im Kapitel 4 wird ein kurzer Vergleich und ein Fazit gezogen
