1 EinleitungIn der vorliegenden Arbeit werde ich die Staatslehre des Thomas Hobbes und die Kritik daran von Carl Schmitt nebeneinander stellen und kritisch betrachten. Dazu bediene ich mich der Suhrkamp-Ausgabe des hobbesschen Leviathans in der Ubersetzung von Iring Fetscher und des Buches 'Der Leviathan in der Staatslehre des Thomas Hobbes' von Carl Schmitt. Bedingt durch die Aufgabenstellung kam kaum mehr Literatur zur Anwendung.Thomas Hobbes war und ist einer der provokantesten Autoren seiner Zeit, insbesondere weil er radikal mit der bisher vorherrschenden Moralphilosophie brach und stattdessen begann, geradezu naturwissenschaftlich zu argumentieren. Seine Werke beschaftigen sich mit Ursache und Wirkung, die Gesellschaft und ihre Elemente folgen dem physikalischen Gesetz der Bewegung. Bewegung bedeutet in diesem Fall Selbsterhaltung, das zentrale Motiv des hobbesschen Menschen. Sein folgenreichstes Werk ist der Leviathan, eine Abhandlung uber die Geburt eines totalitaren Staates, die Grundlagen seiner Existenz, seine Form und seine Gewalt.Carl Schmitt, einer der fuhrenden Rechtstheoretiker nach dem Ersten Weltkrieg, wurde besonders bekannt durch eine Staatslehre, die fur die Notwendigkeit einer starken staatlichen Autoritat eintrat und sich fur einen totalitaren Staat aussprach. Er rechtfertigte damit auch das Dritte Reich und ihre Fuhrerphil osophie. Als bekennender Nationalsozialist und Antisemit machte er dort schnell Karriere und bekleidete viele wichtige Posten.Bei Thomas Hobbes findet Carl Schmitt viele Parallelen zu seinem Staatsentwurf. Der Philosoph von Malmesbury ist fur ihn: '[...]der echte Lehrer einer grossen politischen Erfahrung; einsam wie jeder Wegbereiter; verkannt, wie jeder, dessen politischer Gedanke sich nicht im eigenen Volk verwirklicht; ungelohnt, wie der, der ein Tor offnet, durch das andere weitermarschieren[...]' (Schmitt 1938: 132) Aber diese Bewunderung ist nicht einseitig. I n seinem Buch 'Der Leviathan in der Staatslehre des Thomas Hobbes' analysiert er dieses Werk, in dem er den Werdegang der dort beschriebenen Staatskonstruktion durchspielt. Dabei treten fur ihn die Unzulanglichkeiten zu Tage, die letztendlich den Leviathan zum Scheitern verurteilen.Im Rahmen dieser Ausarbeitung stelle ich zunachst die Grundlage fur Schmitts Werk dar, die anthropologischen Grundlagen des hobbesschen Staates und das darauf aufbauenden Staatskonstrukt.[...
