Dem grenzüberschreitenden Dienstleistungsverkehr werden hohe Wachstumsraten vorausgesagt. Nicht nur in Europa durch das Gemeinschaftsrecht, auch auf globaler Ebene wird eine Liberalisierung des Handels mit Dienstleistungen angestrebt. Den rechtlichen Rahmen schafft das Allgemeine Übereinkommen über den Handel mit Dienstleistungen (GATS) der Welthandelsorganisation. Der Verfasser untersucht, welche Auswirkungen das GATS auf den wirtschaftlich bedeutenden deutschen Gesundheitssektor hat und ob letztlich begründeter Anlass für etwaige Befürchtungen in diesem sensiblen Bereich besteht. Zunächst wird dazu der Gesundheitssektor dargestellt und im Anschluss die Regelungsstruktur und Bedeutung des GATS aufgezeigt. Es wird festgestellt, dass es sich bei den verschiedenen Gesundheitsdienstleistungen um solche im Sinne des GATS handelt. Im Mittelpunkt steht die Vereinbarkeit der deutschen Rechtslage mit dem GATS. Im Ergebnis bescheinigt der Autor dem GATS kaum Auswirkungen auf den Gesundheitssektor und zeigt, dass es den Mitgliedsstaaten viel Raum lässt.

About the Author :
Stefan Schmidt, geboren 1979 in Kirchhellen, studierte von 2000 bis 2002 Rechtswissenschaften an der Universität Bayreuth und absolvierte die wirtschaftswissenschaftliche Zusatzausbildung. Das Studium setzte er an der Universität Münster fort. Nach dem Ersten juristischen Staatsexamen im Jahre 2005 arbeitete der Autor dort als Wissenschaftlicher Mitarbeiter am Institut für öffentliches Wirtschaftsrecht und legte nach seinem Referendariat in Münster und Brüssel im Jahre 2009 das Zweite Staatsexamen ab. Das Promotionsverfahren endete 2009.
