English summary: The Convergence of Contract and Tort Law in Medical Liability Law. A Dogmatic Analysis of the Principles Governing Medical Liability Law In medical liability law, a parallelism of contractual and tortious claims is presumed. However, the consideration of structural peculiarities in contracts and torts shows that a blanket identical standard of liability is not justifiable. This work deals fundamentally with the structure of duties in contract and tort law as well as the evidentiary implications of a dogmatically imprecise justification of liability. It proposes a solution that is structurally inherent in the BGB. German description: Das Arzthaftungsrecht ist eine Materie, die aufgrund der historischen Verankerung des Schmerzensgeldes in 847 BGB a.F. aus dem Deliktsrecht gewachsen ist. Seitdem auch auf vertraglicher Ebene immaterieller Schadensersatz gewahrt werden kann, ruckte auch der Behandlungsvertrag zwischen Arzt und Patient bei Haftungsfragen in den Vordergrund. Dabei wurde unbesehen die deliktische Haftungsstruktur in das Vertragsrecht ubertragen.Wie konnen Vertrags- und Deliktsrecht jedoch unter Berucksichtigung ihrer strukturellen Eigenschaften parallel verlaufen? Konnen vertraglich modifizierbare Hauptleistungspflichten und allgemeingultige Verkehrspflichten inhaltlich identisch sein? Wie unterscheiden sich Pflichtwidrigkeit und Fahrlassigkeit, wenn beide Massstabe auf die verkehrserforderliche Sorgfalt, namentlich den Facharztstandard, rekurrieren? Ist der grobe Behandlungsfehler ein Fall grober Fahrlassigkeit? Diese und weitere Fragen werden vor dem Hintergrund der Dogmatik des BGB beleuchtet.
