In seiner Untersuchung erforscht Hendrik Pekárek die Entwicklung des Straf-, Strafvollzugs und Strafprozessrechts in der jüdischen Rechtstradition, der Halacha, unter literarischen bzw. narrativen, rechtshistorischen und rechtsvergleichenden Aspekten. Anhand von »Kriminalgeschichten« und Regelungsbeispielen aus Torah, Midrasch, Mischna und Talmud, den Schriften Moses Maimonides und mittelalterlichen Rechtsgutachten zeichnet er anschaulich die über drei Jahrtausende währende Entfaltung strafrechtlicher Konzepte sowie die rabbinische Vorstellung eines gerechten Strafprozesses nach und gewährt einen Einblick in das Rechtsleben jüdischer Gemeinden im Laufe der Jahrhunderte. Die mit dem Sonderpreis der Humboldt-Universität 2019 ausgezeichnete Arbeit leistet nicht nur einen interdisziplinären Beitrag zur Erforschung des Jüdischen Rechts, sondern auch zu den religiösen Ursprüngen des säkularen Strafrechts und damit gleichsam zur Aufarbeitung der Strafrechtsentwicklung in Europa.

About the Author :
Hendrik Pekárek is a Berlin lawyer and in-house counsel. The focus of his practical work is on white-collar criminal law, IT criminal law as well as trans- and international criminal law and compliance consulting. His academic interests include the Jewish legal tradition, general legal history, and comparative law. He is a former Research Assistant of the Berlin Studies on Jewish Law and lecturer at the Faculty of Law of the Humboldt University of Berlin as well as a tutor in the student exchange network East-West. He studied law in Berlin, the United Kingdom, and the USA. Hendrik Pekárek ist ein Berliner Rechtsanwalt und Syndikusrechtsanwalt. Die Schwerpunkte seiner praktischen Tätigkeit liegen im Wirtschaftsstrafrecht, IT-Strafrecht sowie im trans- und internationalen Strafrecht sowie in der Compliance-Beratung. Sein akademisches Interesse gilt der jüdischen Rechtstradition, der allgemeinen Rechtsgeschichte und der Rechtsvergleichung. Er ist ehemaliger Wissenschaftlicher Mitarbeiter der Berliner Studien zum Jüdischen Recht und war Lehrbeauftragter an der Juristischen Fakultät der Humboldt-Universität zu Berlin sowie Tutor im studentischen Austauschnetzwerk-Ost-West. Er hat Rechtswissenschaften in Berlin, dem Vereinigten Königreich und den USA studiert.
