Nach § 123 Abs. 1 BGB ist jede Willenserklärung anfechtbar, zu deren Abgabe der Erklärende durch eine arglistige Täuschung oder widerrechtliche Drohung bestimmt wurde. Nur für den Fall einer Täuschung durch einen Dritten schränkt § 123 Abs. 2 BGB dieses Anfechtungsrecht ein. Sebastian Martens untersucht mit einem rechtshistorischen und rechtsvergleichenden Ansatz, wie sich diese Regelung erklären lässt. In einem ersten Kapitel widmet er sich den römisch-rechtlichen Ursprüngen, deren Rezeption und Fortentwicklung auf dem europäischen Kontinent er im zweiten Kapitel darstellt. Im dritten Kapitel wird die Entstehung der entsprechenden Regelungen des englischen Common Law untersucht. Das abschließende vierte Kapitel nutzt die bis dahin gesammelten Erkenntnisse zu einer dogmatischen Analyse und Kritik des geltenden Rechts. Dabei wird gezeigt, dass die unterschiedliche Behandlung von Drohung und Täuschung zu Wertungswidersprüchen führt und im BGB selbst eine einheitliche Lösung angelegt ist. Darüber hinaus wird deutlich, dass das Recht der Willensmängel insgesamt stark von den praktisch eher bedeutungslosen Drittfällen geprägt wurde: Der Anfechtungstatbestand der widerrechtlichen Drohung gewann seine Kontur durch das Bemühen um eine handhabbare Lösung der Drittfälle, und durch die auf das römische Recht zurückgehende differenzierte Behandlung von Drohungen und Täuschungen durch Dritte wurde die Entwicklung eines allgemeinen Anfechtungstatbestandes der widerrechtlichen Beeinflussung verhindert.
