Götz Schulze beschreibt die dogmengeschichtliche Entwicklung der aus dem klassischen römischen Recht stammenden obligatio naturalis neben der heute gleichbedeutenden, aus dem religiös geprägten Naturrecht entstandenen unvollkommenen Verbindlichkeit in Theorie und Praxis und stellt ihre Aufnahme in die europäischen Kodifikationen dar. Die Naturalobligation lässt sich demnach als obligatorische Leistungsforderung verstehen, die nicht mit rechtlichen Zwangsmitteln durchgesetzt werden kann. Sie grenzt sich von schwächeren Bindungsformen, den konsequentialistischen Bindungen (Angebotsbindung, Absichtsbindungen, Obliegenheiten u.a.) und den bislang nicht rezipierten an- oder abgeratenen (supererogatorischen) Handlungen, ab. Der Autor zeigt auf, dass der Gesetzgeber im geltenden Recht eine Reihe nicht erzwingbarer Leistungspflichten anerkennt. Individualrechtliche und rechtspolitische Gründe können dafür sprechen, den Erfüllungszwang ausnahmsweise aufzuheben, da dieser nicht stets angemessen und funktional ist. Die Rechtsfigur der Naturalobligation erlaubt ferner die Inkorporation bestimmter gesellschaftlicher Wertungen in das Recht. So steht etwa das rechtsethische Gebot, in Formen des Rechts zu handeln (§ 242 BGB), einer im Gentlemen's Agreement erstrebten Entrechtlichung entgegen, weshalb es sich anbietet, die Naturalobligation als Rechtsstruktur zugrunde zu legen. Auch sogenannte freiwillige Selbstverpflichtungen sind begrifflich klärungsbedürftig. Mit Hilfe der Rechtsfigur Naturalobligation erläutert der Autor die zugrunde liegenden Strukturen und beschreibt Grenzpunkte rechtsgeschäftlicher Gestaltung.
