Le génie de Berman est celui des auteurs qui savent reprendre la main quand le questionnement social s'enlise, et ouvrir à la pensée le champ des interprétations stratégiques. Libre de ses mouvements, il saisit la généalogie des Révolutions (au sens européen du terme) depuis le Moyen Âge pontifical jusqu'à l'ordre installé en Russie par Lénine, tout comme il fait une critique en règle du positivisme de Max Weber, qualifié si justement de « saint patron des théories sociales au XXe siècle ». Enfin, cette grande leçon: il n'est d'interdiscipline que pratiquée par soi-mème. Sa précision comparatiste, Berman la doit à sa conception d'une histoire du droit capable de se nourrir de théologie, de réinvestir la problématique des liturgies, des productions musicales et poétiques... et de se souvenir de la Romanité byzantine (l'orthodoxie) méthodiquement chassée de nos mémoires. P. L.Harold J. Berman (1918-2007), historien juriste américain, est l'auteur d'une oeuvre abondante, non seulement érudite mais soucieuse de couvrir les grands domaines du droit (méthodes, religion, famille, criminalité, aide sociale, économie...). Les catégories en usage chez les économistes le classent parmi les libéraux.
