About the Book

How do you export a trust? Can you get around section 37(1)(c) of the Trustee Act 1925? Do you need to change the proper law of trust? How do you do that? These are all difficult questions for the estate planning and international adviser. But English law on these potentially crucial questions is confused and fragmentary. This is an updated work combining two monographs printed in 1990, and revised to take into account changes. This may be of interest to practioner interested in exporting UK resident trusts, or indeed concerned with trusts migrating between two or more jurisdictions.

Table of Contents:
Part 1 Migration: jurisdiction of the English court; power to appoint non-resident trustees; will the court appoint non-resident trustees?; if trustees have power, is it appropriate for them to exercise it?; void, voidable or valid?; the machinery of discharge and appointment; the number of trustees; discharge of retiring trustees; vesting the trust property in new trustees; exchange control; "Flee" causes; indemnity for retiring trustees. Part 2 Change of proper law: the role of the proper law; more than one proper law; changing the proper law alternatives; powers to change the proper law; who should exercise a power to change the proper law?; effect of a change on beneficial interests; drafting considerations; appendix - the Recognition of Trusts Acts 1987 (incorporating the Hague Convention on the law applicable to trusts and their recognition).
