About the Book

The first edition of this book was the first UK text to examine digital copyright together with related areas such as performers' rights, moral rights, database rights and competition law as a subject in its own right, and the second edition dealt with the UK implementation of the 2001 Copyright Directive. Now in its third edition, the book has been updated to address developments in copyright law, database law and moral rights and expanded to cover copyright law and user-generated content, and the development of Web 2.0 and beyond. Important recent UK, EU and US cases are discussed. As the UK Government and the European Commission explore possible changes to copyright law and as both the public and private sectors rely more and more on digital content and services, copyright law continues to be a hotly debated topic. This book helps to put the ongoing copyright debate into perspective and provides practical guidance for those creating or exploiting digital content or technology, whether in academia, the software, information and creative industries, and other areas of the economy. The focus is on the specifics of the law in this area together with the practical aspects, including precedents and precedent checklists dealing with common digital copyright transactions. Both academics and practitioners will find the book an invaluable guide to this rapidly developing field of law.

Review :
Reviews of the 2nd Edition Simon Stokes has once again written a work that somehow manages to be both concise and comprehensive. This is a most impressive achievement wrapped up in a highly readable volume...Within its pages legal practitioners and academics, students, and those with a general interest in the regulation of our increasingly digitised world will find a treasure trove of useful information and analysis. Professor Fiona Macmillan The Journal of E-Commerce, Technology and Communications Vol 13: Issue 1, Jan 2007 ...an invaluable guide to creators of rights, at any stage in their career, and to their advisors. Ruth Soetendorp The Law Teacher, Vol 41, No 1 2007 This second edition of Simon Stokes' excellent text is that rare thing, a book that combines detailed analysis of the relevant law and useful practical guidance in a succinct, readable, well-structured form. It will be valuable to anyone with an interest in this area...The strength of this book is that, as well as engaging with high-level theoretical and policy arguments, it analyses the specific application of copyright law in the digital world, and builds on this to discuss specific practical issues for the lawyer or advisor. Helen Dakin Copyright Reporter, Vol 24, No 3 Oct 06 The text is crisp and clear...The author employs examples and cases drawn from numerous jurisdictions, checklists and chapter summaries to great effect. Professor Jeremy Phillips European Intellectual Property Review, Vol 28, Issue 3 March 2006 ...a most scholarly work and the issues are structured very cleverly which enlivens the reader's interest. There is also great emphasis on practical aspects; it is well researched and will undoubtedly be essential reading and prove useful the practitioner, academics and students. Hasina Haque, University of Strathclyde SCOLAG Legal Journal February 2006 The overall result is a text that has achieved Stoke's objective of providing copyright professionals with a useful and commercially focused synopsis of the laws relevant to the commercial exploitation of creative works in digital form. William Bowes Learned Publishing Volume 23, No. 2, April 2010
