About the Author :
Carrie Okizaki is the cofounder and president of Modus Strategic Solutions, Inc., a consulting firm that helps organizations manage and successfully deliver large capital projects through thorough and objective project oversight, assessment, and management services. She began her career as a construction lawyer and litigator, serving clients in all areas of the construction industry. As a consultant, Ms. Okizaki has broad experience in providing advice to project owners, contractors, and other stakeholders related to planning and managing all stages of the construction project lifecycle, including supporting the development of contracting strategies, contract negotiation, and project risk management and advising on day-to-day commercial and claims issues. She has led contract negotiations on billion-dollar construction contracts and provided project management oversight and consulting and legal services for projects worth in excess of $75 billion. Ms. Okizaki is a longtime member of the American Bar Association’s Forum on the Construction Industry and participated in several Forum publications as both an editor and an author. She received her B.S.F.S. from Georgetown University and her J.D. from the University of Colorado School of Law. Terrence L. Brookie is a member in the Indianapolis, Indiana, office of Frost Brown Todd LLC. He concentrates his practice in the area of construction law, surety law, and business litigation. Mr. Brookie is a frequent speaker for construction and commercial groups and has lectured and written numerous articles for several industry groups and professional organizations in the construction industry. He is a member of the ABA's Forum on the Construction Industry (Governing Committee Member), TIPS Fidelity/Surety Law Committee, and Construction Litigation Committee. Mr. Brookie received his B.A. from Denison University in 1978 and his J.D. from Indiana University School of Law in 1981. He is a Fellow of the American College of Construction Lawyers and selected by his peers for inclusion in The Best Lawyers in America, 2005 -- 2010. August 2010 Eric A. Berg is Of Counsel with Ogletree Deakins, in Chicago, Illinois. He focuses his practice on construction law, in both litigation and transactional work. As a litigator, Mr. Berg has represented owners, contractors, subcontractors, architects, engineers, and lenders in lawsuits, arbitration, and mediation. Mr. Berg’s transactional work includes drafting and negotiating contracts for the design, construction, rehabilitation, and construction management of hotels, hospitals, office buildings, apartment buildings, private residences, retail stores, factories, and warehouses. In addition, Mr. Berg is well versed in all facets of the Americans with Disabilities Act and the Fair Housing Act. Chambers and Partners lists Mr. Berg in Chambers USA: America’s Leading Lawyers for Business. Mr. Berg has been named an Illinois Super Lawyer, in Best Lawyers in America, and among America’s Leading Lawyers for Business. He is rated AV® Preeminent (5 out of 5) by Martindale-Hubbell, the highest ranking available. A graduate of Northwestern University School of Law and Yale University, he resides in Chicago. Misty Gutierrez is a partner in the law firm of Thomas, Feldman & Wilshusen, L.L.P. Misty is board certified in construction law by the Texas Board of Legal Specialization and represents clients from all segments of the construction industry in disputes involving breach of contract claims, delay claims, foreclosure of mechanic's and materialman's liens, design defect claims, and other construction-related claims. Misty’s experience also includes drafting and reviewing construction contract documents. Misty graduated with honors from SMU Dedman School of law and obtained a B.A. from Texas Tech University.
