B., &C. &C. &C: On a Charge of Having, as a Citizen of the United States, Levied War in the Province of Upper Canada Against Her Majesty the Queen of Great Britain, &C.; With His Defence and Other Documents I come now to consider the testimony of John Prince and Prideaux Girty, Esq1s. And that part of the charge against me, which alleges that within the limits of this province. I was in arms against her Majesty, against the fo1m of said statute. Col. Prince and Capt. Girty, both testified that on the 4th of March inst. They were travelling on the shores of Lake Erie f1om Gosfield to Amherst burgh, whenthey discovered, in the w01dsofcol.p1ince at agreat distance two objects on the we. Captain Girty testifies that after driving one mite towards Amherstburgh, they discovered the two objects to be me Col. Prince testifies he discovered the two objects which they had seen at so great a distance on the ice to be men, in twenty minutes from the moment they first discovered them - sand both, conceiving them to be spies, Col. Prince with two fresh horses and sleighs, With at Mr. Haggerty went ln pursuit. He, Col. Prince, testifies he prevailed on Capt. Girty to remain where he was, be cause he was unwell and his horses tired. Capt. Girty testifies that he for a few moments halted at the place with his sleigh, and.as4 he thought he discovered the persons running, he drove after them, This is remarkable as Col.
