Rauvooroo Chelmiah, (Pauper Plaintiff, ) Respondent. 1. Appellant states. The Respondent sued him and other Defendants for recovery of real and personal property valued at rupees 1,343-15, which case the Siulr Ameen examined and passed a decree against him, for the property valued at rupees 235-3 6 with costs, with which being dissatisfied he brought this appeal. 2. Appeal reasons. The Sudr Ameen in his decree allows that he and the Respondent are living separately since the year 1835, but considers by the document marked A, produced by Respondent that they are undivided, but that document does not show it was executed to give him a share in the estate. By the public Document No. 2 on his part, it is clear that the decree amount collected in No. 94 of 1833 was received by them both, and receipts were produced to that effect. This fact the Respondent allows in Para. II of his reply, whereas the Sudr Ameen gives a decree in his favour against him for his share of that decree amount which he had already received, because he was a minor up to the year 1833, and under his guardianship, but there is no proof on the part of the Respondent on this point, nor is there any evidence to show the whole amount wasjtakcuby him alone. The Respondent was 18 years of age in 1833, but not a minor.
