Continuous Line of Eaihray?Forwarding Traffic?Coal Traffic?Appeal?Railway April 10, 27, and Canal Traffic Act, 1854, . 2. May 17, 1877. The obligation imposed upon every railway company to afford all duo and reasonable facilities for receiving and forwarding by its railway traffic coming by another, which forms with it a continuous line of communication, is not limited to the oases in which a railway company has accommodation to take over such traffic at the point of junction. Upon complaint by the lessees of a colliery, situated on the N. and B. Railway, at a short distance from its junction with the M. Railway to S., that they were prevented sending the traffic of their colliery to S. by the railways of the two companies, which formed a direct route, and in consequence had to send it by a circuitous route, it was proved that the two railways formed a continuous line of communication, and that, physically, there was no difficulty in the traffic of the colliery being carried to S. by the direct route. Held, that the applicants were entitled, under sect. 2 of the Railway and Canal Traffic Act, 1854, to have their traffic conveyed by any route they pleased, and to use the two railways as if they were one continuous line. This was an application by the Victoria Coal and Iron Company under the 2nd section of the Railway and Canal Traffic Act, 1854 (1), for the purpose of obtaining due facilities from the Neath and Brecon and Midland Railway Companies for forwarding coal and fireclay from the applicants' colliery to Swansea, and to other places on the Midland Railway via Tnis-y-geinon Junction.
