Excerpt from Über Begriff und Begründung der Sittlichen Gesetze Zunächst derbegrifl' der göttlichen Gesetze war es nun, welcher zuerst zu dem der Naturgesetze hinüberleitete. Diejenigen Normen des Handelns, welche nicht blos für die Angehörigen einer gegebenen Gesell schaft im Verhältnifs zu ihr und ihren Mitgliedern, sondern für alle Men schen und allen gegenüber gelten sollten, wie die Heilighaltung des Eides, die Pflichten der Gastfreundschaft, der Barmherzigkeit, des Edelmuths gegen Hülflose und Schwache diese Anforderungen konnte man nicht von dem Willen einzelner Völker oder Fürsten herleiten, da man sie überall anerkannt sah; sie liefsen sich nur auf den Willen der Gottheit zurück führen. Fragte man aber, wie dieser Wille den Menschen bekannt ge worden sei, so konnte man aus demselben Grunde nicht an eine von jenen positiven Ofl'enbarungen denken, auf die man bald nur einzelne gottesdienstliche Einrichtungen und Stiftungen oder einzelne Satzungen des bestehenden Rechts, bald auch, wie bei den Juden und andern Orien talen, den ganzen Bestand der religiösen und bürgerlichen Gesetzgebung zurückführte; sondern diese Klasse göttlicher Gesetze mufste allen Men schen und Völkern von Natur bekannt, sie mul'ste ihnen in ihrem eigenen Be wufstsein, in der Stimme ihres Innern geoffenbart sein. So erhielt man den Begriff göttlicher Gesetze, welche trotz ihres höheren Ursprungs doch für den Menschen, vermöge der Art ihrer Mittheilung, zugleich Gesetze seiner eigenen Natur sein sollten. In diesem Sinn bezeichnet 2. B. Em pedokles (b. Arist. Rhet. Iis. 1373 b 14) das Verbot, lebende Wesen zu tödten, als ein Gesetz für alle, das sich soweit erstrecke, als das Son neulicht und der unermefsliche Luftraum, und bei sophokles beruft sich Antigone auf die ungeschriebenen und unerschütterlichen Satzungen der Götter, die nicht erst seit gestern und heute, sondern von jeher gelten, "und niemand weifs, seit wann sie geofl'enbart sind) Noch näher rückt aber Heraklit den Begriff des göttlichen Gesetzes dem des Naturgesetzes in dem bekannten Wort (stob. Floril. III, "es nähren sich alle menschlichen Gesetze von Einem, dem göttlichen; denn dieses herrscht so weit es Will, und ist stark genug für alle und ihnen überlegen. Hier ist das göttliche Gesetz nicht blos eine Norm für das menschliche Han deln, sondern es fällt zugleich mit der allgemeinen Weltordnung zusammen.
