Chicago, eta, Underground Co. v. Congdon. etc, Mfg. Co.. Ill--809. Question whether summons has been properly served should be raised by motion to quash, not by plea in abatement Greer v. Youngs, 17 111. App., 106. Pendency of premature action to forfeit lease (premature for lack of proper statutory notice), no ground for abatement of action of forcible detainer. Steele v. Grand Trunk Junction R. Co., 20 111. App., 366. Judgment on finding issues for plaintiff upon plea in abatement is interlocutory or final according to the nature of the action. If action be for damages in assumpsit or tort, it is interlocutory. But if it be debt for a sum certain, or for specific recovery of land or goods, it is final. The latter rule of final judgment prevails in forcible detainer. Id. In United States courts plea of prior action pending is plea in abatement Stephens v. Monongahela Bank, 111 U. S., 197. Whether a plea is in abatement or in bar is to be decided by its conclusion, not from its subject-matter or commencement; e. g., a plea in substance in abatement concluding in bar, is a plea in bar.
