We deden vroeger in dit Tijdschrift mededeeling van twee processen, den zin en de beteekenis van het bovengemeld artikel betreffende, waaromtrent thans door den Hoogen Raad, bij twee arresten van den 23,"cn Maart 1855, de eindbeslissingen zijn gegeven. De primitive eischers, bij twee vonnissen der Arrondissements Regtbank te Arnhem in het gelijk gesteld, in appel, door het Provinciaal Geregtshof van Gelderland, afgewezen, waren tegen deze beide arresten gekomen in cassatie. I. Wat de eene zaak aangaat, waarin de Arnhemsche Regtbank vonnis wees, den Maart 1853, in zijn ge heel medegedeeld in dit Tijdschrift, A. 1853, p. 277 sqq, terwijl het arrest van het Hof van Gelderland, d.d. 15 Maart 1854, te lezen is in dit Tijdschrift, A. 1854, pag. 255, sqq, --gelooven we, zonder verdere herinnering van feiten of omstandigheden, te mogen aanvangen met de vermelding, dat tegen het even aangehaalde arrest van het Hof van Gelderland, aangevoerd werden twee middelen van cassatie: Vooreerst: schending en verkeerde toepassing van art. 896 Cod.
