Kap. des Traktats uber Politik. Seine vollstandig korrekte Auffassung vom Recht lasst sich kurz wie folgt wiedergeben: Im freien Naturznstand giebt es kein Recht und kein Unrecht. Hier thut Iedermann und kann Iedermann thun was ihm beliebt. Wurde Jeder vernunftig sein, so wurde allerdings Ieder nur das thun, was im Zustand der Zivilisation als Recht gilt. Aber es ist eben nicht Ieder vernunftig, sondern die Wenigsten sind es, und daher folgen die Menschen ihren Affekten. Erst im Zustand der gesellschaftlichen oder staatlichen Vereinigung taucht der Rechtsbegriff auf. Unrecht ist, was nach den allgemeinen Normen nicht geschehen darf und mit Strafe belegt ist, Recht, was durch den gesellschaftlichen Willen nicht verpont ist. Wie der Werthbegriff nach K. Marx, eine gesellschaftliche Kategorie ist, indem er eine Gesellschaft voraussetzt, welche Waaren zum Tausch produzirt, der Werth der Waaren also keine diesen immanente Eigenschaft ist, wie die burgerlichen Oekonomen geglaubt hatten, ( Fetischkarakter der Waaren," spottet Marx, ) so ist auch nach Spinoza (ebenso auch nach dem englischen Philosophen Th. Hobbes) das Recht eine gesellschaftliche Kategorie. Lassen wir ihn selbst sprechen: Jeder existirt nach dem hochsten Recht der Natur, und folglich thut Ieder nach dem hochsten Recht der Natur das, was aus der Nothwendigkeit seiner Natur folgt.
