Excerpt: ...I must, however, guard against any misconception or misapprehension of what I say; I do not mean ' to say that the ofiice ofa licenser ofthe press ' ought to be revived; I am not of thatopimon; and I say so to prevent misinterpretation, and ' to prevent what I have said being distorted by calumny. I said that the liberty of the press was dear to Englishmen, and Iwill say that nothing can put that in danger butthc licentiousness of the press. The defence which has been urged to-day was made up of materials which have been evils, unless we are convinced that out _ often usedbel'ore, sometimcs eloquently, sometimes a little unskilfully, but alwa s eloquently by the learned counsel who efcnded this cause; but the materials are all the same, although they have been waftcd over the Atlantic, and have been there again most eloquently handled, ---I mean the general right to the liberty of the press. After all, the truth of the matter is very simple when stripped of all the ornaments of speech, and a man of plain common sense may easily understand it; it is neither more nor less than this, that a man may publish any thing which twelve of his countrymen think is not blameable, but that he ought to be punished if he publishes that which is blameable. This, in plain common sense, is the substance of all that has been said upon the subject. There are two questions submitted to the consideration of the jury; the first is, whether the publication be a libel or not? Upon that I question I am a little too deeply pledged, to give an unbiassed 0 inion upon the matter. I know am mostf ible, and therefore ought to distrust my own judgment; but in support of that udgment two specialjuries of the city of Lon on have pronounced without the least hesitation, ...
