Excerpt: ...those dependent on the deceased member is violative of Laws Ill. 1893, p. 130, sec. 1, which provides that an affianced husband or aflianced wife may be a beneficiary of such member; and in such case the statute and not the by-law controls the rights of the parties. Same--Same--Same--Right of Fiancee to Maintain Action: In his application for membership in a fraternal benefit order, a duly initiated member thereof designated A. M. (therein called A. W., using his own last name instead of her maiden name) as his aflianced wife, and as the party to whom he desired the endowment paid. The oflicers of said order declined to issue a beneficiary certificate in favor of the party named, on the ground that it was not competent for a member to designate his aflianced wife as a beneficiary, under the constitution and laws of the order. The Laws of Ill. 1893, p. 130, sec. 1, provides that an aflianced husband or wife may be a beneficiary of such member. No certificate was issued at the time of insured s death, he having refused to designate any other person. In a contest between the beneficiary named in the application and insured s brothers and sisters. who were the next of kin and beneficiaries under the bylaws of the order: Held, That the statute must control, and that insured s aflianced wife could recover in an action against the order for the death benefit.
