Broadly and briefly, it consists of a petrol-driven motor which, by creating a vacuum, gathers up dust and dirt and passes them through india-rubber tubes into a receptacle fitted on to a truck. When the process is applied to a good-sized house it is naturally a work of some time, and involves the truck remaining stationary in the street for several hours. Naturally, too, it causes a certain amount of noise, and a little curiosity, though doubtless the latter will subside with greater familiarity. That it is calculated seriously to interfere with traffic (unless, perhaps, in the case of exceptionally narrow and crowded thoroughfares) we do not for a moment believe, and certainly there was no evidence of any such interference in the case to which we are about to refer. But just as it was endeavoured to apply to bicycles the provisions of sundry old Acts of Parliament (passed long before this mode of locomotion was ever dreamed of), as to "carriages hung on springs," "sledges, drags, and such-like carriages," and so forth, so the aid of the Metropolitan Police Act, 1839, has been invoked to embarrass this infant, but rapidly growing, industry. In Dunn (appellant) v. Holt (respondent) (noted at p. 406), one of the employees of the British Vacuum Cleaner Company, Limited, appealed from the decision of a magistrate who had convicted him, under sec. 54 of the Act, of "wilful obstruction" of a thoroughfare, by allowing a truck to stand for several hours outside a house in which the apparatus was being used. Even had there been anything in the nature of actual obstruction, or inconvenience to the public, it is difficult to see how it could have been considered "wilful." But, so far from...
