Not illustrated. 1920 Excerpt: ...of the cases just cited were cases wherein the vessel whose duty it was to keep her course was steamers going along like that (indicating), and this one is to keep out of the way of the other. If he tries to go under the stern of this one, and this one slackens her speed, he runs into the very danger which he wishes to avoid; whereas, if he knows that this vessel, out of the way of which he has to keep, is to keep her course and speed, he knows it is perfectly safe for him to go under the stern of that vessel. Therefore, we say it is essential that these steamers, at night, should know what the other vessel is going to do. "The delegates well know that until there has been time enough to watch a vessel carefully or to take the compass bearings, it is very difficult to arrive at the actual speed a vessel is going, but if every sailor knows that the vessel out of the way of which he has to keep will keep her speed as well as her course, then he will know when it is perfectly a sailing vessel, yet the principle involved is the same in the case of two steamships crossing, where it is the duty of the one who has the other on her starboard bow to keep out of the way of the other, and of the latter to keep on her course...." It has also been said by the District Court in The Europa, 116 Fed. 696, 698: "Where a sailing vessel and a steamer are proceeding in a direction that may involve collision, the duty of the former is to hold its course, while the latter keeps out of its way. The observance of the rule is no more strictly required of one than of the other. The rule creates a mutual obligation, whereby the sailing vessel is required to hold its course in order that the other may know its position, and not be led into erroneous maneuvers in endeavo...
