Excerpt: ...should hold that his disqualification did not extend to the whole Committee, then we submit that the plaintiff, if tried at all, was acquitted; that a mistake was made in announcing the vote; and that he is still a member of the Club. For, whether the Governing Committee was composed of twenty members, as claimed by the defendant, or of twenty-one members (including Mr. Bristowl, as claimed by the plaintiff, then, even on the construction of the Constitution most favorable to the defendant, that a two-thirds vote of the legally existing members of the Committee would be sufiicient to expel, fourteen members would still be required. But Townsend being omitted, as he surely must be, unless all the cases are to be overruled or held to be inapplicable, then only thirteen votes were cast against the plaintiff, and he was therefore acquitted. We ask the Court to pass specially upon this question. Third l'0illt.--The failure to notify Mr. Bristow, who was then a member of the Governing Committee, of the wecial meeting held on May 25th, 1882, at which the pretended resolution of earpulsion was passed, was not only unfair towards the plaintifi, but also rendered said resolution null and void, because the meeting was not legally organized. (a.) Mr. Bristow was a member of the Governing Committee, and was therefore entitled to be present at the special meeting held on May 25th, 1882.
