Not illustrated. 1886 Excerpt: ...false case in the Plaint and has supported it by grossly false and perjured evidence, I would dismiss the Plaintiff's suit with costs throughout. A. Ramachendra Iyer, J: --Having carefully considered the evidence, I have arrived at the conclusion that the case alleged by the Plaintiff was wholly false, and that the suit must fail. The Plaintiff's case was, that the bill of exchange was endorsed to hhn for value by payee on 10th January 1885, and that his Agent presented it at Bangalore for payment on the 13th January. The learned Judge, who tried the case, was of opinion that these were deliberately false statements, and that the Plaintiff and his Agent were guilty of perjury. I entirely concur in this finding. The letters written by the third Defendant to the second, on 14th, 17th and 19th January 1885, convince me, that he had the bill in his possession on those dates, and that the Plaintiff could not have obtained it as endorsee on the 10th idem. I agree with the Chief Judge that, on this finding, the suit ought to have been dismissed. Notwithstanding this finding, the learned Judge decreed the Plaintiff's claim, because he was of opinion that the bill was endorsed to the Plaintiff for value sometime between the 16th and 19th January. I regret that I cannot agree in this finding. It is clear to my mind, that the 3rd Defendant (the payee) received the bill from the 2nd Defendant as his Agent, for the purpose of procuring it to be discounted. He had evidently no power to negotiate it without the express order of the drawer. If he had that power, I do not understand why he applied on 14th January for permission to negotiate (vide Exhibit 3).
