On this head, in a MS. before me, written by Mr. Ferguson, of Pitfour, an Advocate and after a Judge, of universally accredited talents, he observes, viz. "That neither the Articles of the Union, nor "any laws made since that time, have introduced "any different rule of interpretation with regard "to the rights of succession to Scotch Peerages; "and any doubts which may arise must be de"cided by the laws and customs of the country." To every one acquainted with his profound knowledge in the law of that country, there cannot be an individual authority higher than his. IV. OBSERVATIONS with REFERENCE to the TITLES OF DUKE OF CORNWALL, AND DUKE OF ROTHSAY. These two titles were nearly co-eval in their first creation, and consimilar with regard to their limitations of inheritance to the illustrious Princes on whom they were conferred by their respective Royal Fathers. But as they were instituted by distinct, and independent Sovereigns, so they never became coalesced in enjoyment by one person, until the accession to the throne of England by King James the Sixth of Scotland; on which occasion, his eldest son, Prince Henry, as Duke of Rothsay in Scotland, was intitled also to be Duke of Cornwall in England, he being then the King's eldest son, inheritable to both kingdoms. Cornwall, being an English honour, consequently is the first to be noticed. THE DUKEDOM OF CORNWALL. Concerning this dignity, it appears from a record of Trinity Term, the 30th of Henry VIII., in the office of the King's Remembrancer, in the Exchequer, viz.
