Not illustrated. 1883 Excerpt: ...with Mr. Macbraire's enjoyment of the opposite fishery, and soon adopted an ingenious modus operandi. It constantly happens that, during the winter, heavy floods and masses of ice, descending the river, disarrange the bed of the stream, plough out large cavities in the gravel at some places, and pile up high mounds in others. In January, 1872, the floods were unusually heavy, and the bed of the stream suffered greatly on the Scotch side. Mr. Macbraire, as was his invariable custom, proceeded to restore the bed of the river to its original state, by filling up the holes, and scraping down the accumulated mounds, these operations being essential to enable the fishers to shoot their nets without risk of their being destroyed by the accidental unevenness of the bed. Mr. Mather at once applied to the Court of Session in Scotland for an interdict against Mr. Macbraire, in which he sought to have it declared that Mr. Macbraire had no right to interfere with the bed of the river on his own side. In this, Mr. Mather was unsuccessful, so that Mr. Macbraire, to commence the series, scored two victories. Determined, however, not to be beaten, Mr. Mather then procured five enormous stones, each upwards of a ton in weight, and sunk them on the south, or English side, just within the middle line, thus effectually preventing Mr. Macbraire from drawing his nets beyond the middle line of the river, and rendering both fisheries practically worthless. Mr. Mather could well afford to destroy his own fishery at the locus in quo, because he happened to be the owner of another fishery on both sides of the river about a mile higher up than the scene of contention, and the destruction of the Macbraire fishery resulted in Mr. Mather's catching at his upper fishery all the fish which ...
