IN our Common Action not bailable, we began with a bill of Middlesex; but in order to shew the distinction between the two writs, we shall begin our bailable action with a latitat, as a bill of Middlesex is rather an incomplete kind of writ, as wanting the testej. but a latitat has all its proper parts. Bailable process also differs from that not bailable, inasmuch, as the former has an ac etiam added to it, and the latter a notice. So that a latitai with a notice like the one we added to the bill of Middlesex, may be a common process j and vice versa, a bill of Middlesex, with an ac etiam instead of a notice, may be made a bailable writ. The attorney's name, his place of abode, and day of the month on which the writ was sued out, must be written on the back of a bailable, as well as on the back of a writ not bailable, together with the addition of the sum sworn to. As no person can be arrested, unless the plaintiff or some person for him who knows the fact, make an affidavit of the debt as due to the plaintiff, which cannot now be for a less sura than 10L and in case a defendant be arrested by any other writ than a process; that is, if he be arrested by original, the plainDefendant. CHAPTER I. Preliminary Observations, THE first thing which a defendant ought to do when he is arrested, is to examine the return of the writ, which always appears by the flieriff's warrant to the officer the reason of this is, that he may distinctly know what time he has to put in bail above, for if this be neglected, the bail below, /'. e. the persons security to the sheriff will become fixed j when the plaintiff may take an affignment from the sheriff of the bail bond, and bring actions as well ...
