Excerpt: ... III.--The Trial of Major Falconer for Perjury. On Friday, 20th May, 1653, one Major Richard Falconer, who had been employed as a spy in Holland in 1650-51, was tried for perjury before Lord Chief Justice Rolle and other Judges of the Upper Bench.1 This man, who was described as of Westbury, in the County of Southampton, gentleman, and was said to have belonged to a decent family and to have been educated at Oxford, had appeared before the Committee for compounding with delinquents and sworn a detailed and circumstantial statement with the intent to obtain a share of Lord Craven's estate. The substance of his sworn information was that he had seen his Lordship in company with Prince Charles at Breda, that he had overheard their conversation, that Lord Craven had promoted a petition in which the Parliament was described as being composed of barbarous and inhuman rebels, and that arrangements had been made with divers officers of the Parliamentary party of a distinctly treasonable character. Against this it was alleged that at the date assigned by Falconer for this interview, Lord Craven had been to Falconer's knowledge eight hundred miles from England and from Breda, and that he had taken no part whatever in any such proceedings, if in fact they ever occurred. This being brought before Parliament, and it further appearing that Lord Craven's estate had been sequestered and sold by order of the Committee, upon the faith of these statements, it was resolved, after much debate, that Major Falconer be prosecuted in the Upper Bench, and a trial at Bar was accordingly ordered by the Lord Chief Justice.
