But finding it expedient, that the lieges he in 'certainty as to this point for the future, they de1 clare, that if hereafter any decreets of adjudication proceeding without probation of the rental, and ad4 judging the debitor's estate in general, without re4 striction, shall be extracted for a fifth part more, 4 they will not sustain and restrict these decreets of 4 adjudication, but will find the same void and null, 4 as if they had never been pronounced.' 19. Expenses of the process of adjudication. In the case of an adjudication in implement, where opposition is expected, a conclusion for expenses is sometimes thrown into the summons; but whether concluded for or not, if expenses are found due, care should be taken that they are modified and decerned for in name of the agent, and so as not to load the decree of adjudication or abbreviate with them. The common adjudication for debt under the act 1672, being to all intents and purposes a step of real diligence, it is quite improper to put any conelusion for expenses into the summons. At the same time, if the decree is nimiously opposed by the debtor himself, or by any competing creditor, the Court may, and in practice do, find expenses due by the opposing party, although not concluded for in the summons.
