Excerpt: ... claimant to file another declaration would have still further postponed the commencement of pension; therefore, in claimant's interest, the latter course was pursued and the pension was made to commence December 18, 1893. In view of the complications which have arisen, I can see no authority of law for changing the action which has been taken. It is therefore affirmed. Dependence--Act June 87, 1890, And Section 470t, R, S. Mary Kille (mother). A widow mother 77 years of age, whose only property consists of her home, paid for in part by her dependent mother's pension money, and which, with her personal property valued on assessment at $1,000, does not yield her a support without her daily labor, is dependent within the meaning of the pension laws. Section 4707 is only modified by the first section of the act of June 27, 1890, to the extent of substituting present dependence, in place of dependence at date of soldier's death, and such mother's remarriage prior to the passage of said act is no bar to pension thereunder. Assistant Secretary John M. Reynolds to the Commissioner of Peiisiont, April 5, 1895. The only question involved in this appeal is the dependent condition of claimant. In your communication of February 5, 1894, you state that, August 1, 1890, the applicant filed a claim (No. 31,187) for pension under the act of June 27, 1890, as the dependent mother of John T. Sayre, late of Company A, One Hundred and Twelfth New Jersey Infantry; and that the claim was rejected October 28,1893, on the ground that the claimant is not without other means of support than her own labor.
