Not illustrated. 1898 Excerpt: ...the interference of equity in this case is apparent from the length of time the complainant has allowed to elapse since the erection of the alleged obstructions and the impossibility of any immediate injury resulting from delay; and that the Academy's right is not clear is evident from the nature of the specific grounds averred in denial thereof, while it seems that any attempt to determine the facts involved in the questions of law must be necessarily futile, in view of the defendant's right to have them established by a jury." The Master was therefore of opinion that the complainant's bill should be dismissed, but that leave might be granted, if desired, to maintain an action at law. Both plaintiff and defendant filed exceptions. George W. Biddle, for the plaintiff. /. Tyson Morris and Charles Chauncey, for the defendant. April 8, 1893. Willson, J. Exceptions have been filed on behalf of the plaintiff to the report of the Master, who finds that the plaintiff has no equity under which it can enjoin the defendant from maintaining certain bay-windows constructed by her, which project over a certain alley running along the east end of her properties, which front on the east side of Fifteenth Street, below Locust Street. Many questions have been discussed with great elaboration by the learned Master; but we shall find it necessary, in the view which we take of the case, to discuss but one. That is a radical question, and if our conclusions upon it are well founded, they will dispose of the whole contention. The defendant's title was acquired under a line of conveyances which, so far as they related to the particular two lots of ground owned by her, run back to 1835, when Isaac S. Lloyd conveyed the said lots to two different grantees, in each case naming ...
