But they have not been able to satisfy themselves that there was then, or that there is now, any existing statutory provision authorizing such allowances. And they have felt themselves called upon to decide upon this hill, according to the evidence in the case, and according to their sense of right, in the absence of any law in relation to the subject. They fully concur in the opinion expressed by the Secretaries of War and the Navy in September, 1829, when this very claim was brought to their consideration, in the statement of the claimant's account against the United States for disbursements as agent of the board of commissioners of the naval hospital fund. The committee subjoin the opinion of those officers: "september 7, 1S29. "Mr. Fillebrown, it appears, was appointed secretary November 7, 1825. He can be entitled to pay, as such, only from the date of his appointment. The allowance of one per cent, on the moneys disbursed cannot be allowed, unless authorized by some existing law. None such is known to the commissioners; of course, they cannot have authority to admit it. "J. H. EATON. "JOHN BRANCH." In consequence of the promulgation of this opinion, such proceedings subsequently took place, upon the subject matter of this claim, that the United States were compelled to commence a suit against the petitioner to recover the balance found in his hands on auditing his accounts, which proceedings will be again referred to in this report.
