This section relieves the farmer from responsibility if he sells seed on his own premises, which he raised himself, to another farmer who intends using it himself and does not intend selling it againj The buyer will have to use his own judgment, and if he has any doubt about the seed, he can ask that it be sold to him subject to the provisions of this Bill. On section 8--penalties; liability of purchaser in good faith; report by magistrate. Mr. FISHER. I beg to move, in amendment to this clause, that it read: 'Shall be liable, for the first offence, not exceeding $1, and each subsequent offence not ex-ceeding $5, together with the cost of prosecution, for each receptacle, package, sack or bag, but the total amount of the fine in the case of a first offence shall not exceed $5 and, in the case of a second, $25.' I am making these modifications to meet the representations of the seedsmen, who complain that in certain circumstances a very heavy penalty might be imposed, altogether out of proportion to the offence, if the clause were not modified. The infliction of a penalty is not so much what is desired as a deterrent, as the exposure of bad seed and conduct contrary to law. Mr. BOYCE. I would suggest to the hon. minister the insertion in the second line of section 8, after the word 'person' the word 'knowingly.' That would considerably minimize the harshness of this penal clause. It would also carry out the idea of the minister, who has expressed the desire that this measure might, while being made effective, bear as lightly as possible in the way of penalties.
