(q), If an execution, issued in favour of a married woman, on a judgment in an action commenced by her (ft) 1 Sfat. 282,283,54Q. (q) 2 Mm. T. R. 1V Chap. V. Execution. while single, be levied upon land, she must, as the creditor, choose one of the appraisers, and such must be the return of the officer. And though the estate of the debtor be but an estate for life, or a chattel interest, he holding under a lease for nine hundred and ninety-nine years only, it must be appraised and set oiV in the same manner as where he is tenant in fee simpie.(r) Any justice of the peace, of the town where the land lies, may appoint a ppraisers, though not the nearest to the land: And if the parties agree upon a tenant of the debtor for an appraiser, knowing him to be such, neither of them may afterwards allege that he was not indifferent; and an appraisal by him will be good. (#) But an appraisal made by a freeholder of another town, though agreed upon by the parties, will be bad, and the levy void, and no title be acquired by the creditor in such execution. (/) After a levy upon land by the direction of the creditor, and an appraisal thereof, the officer cannot desist, and at the request of the creditor, take personal estate; and if he so do, an action of trespass lies against such officer for the taking such personal estate, as much as if the execution had been satisfied years before, (w) / The officer who levies an execution upon land, whether the estate of the debtor therein, be an estate in fee or for life, ..
