Not illustrated. 1891 Excerpt: ... wrote and sent the following notice: --May 21, 1886. Mr. W. G. Crawford, I notify you by these lines that the oil and gas well you and others got off me off ray farm in Adams Township, Butler County, State of Pennsylvania, dated June, 1885, has expired, and now I declare said lease null and void and not binding on me, as you have not complied with the stipulations of said lease, and now yon take the machinery away off my land in 48 hours or I will lay claim on said machinery. S. A. Kennedy. The plaintiff testified that the notice was actually written and sent in June, and that " May" was written by him in error, and that he sent it on the 21st because he mistook the " 7" in the lease for a " 1" and intended that it should be sent on the day a year after the lease was made. That he did not interfere with the defendant's possession or with any operations in any way. Defendant admitted that no tubing had been put in the well and no oil actually pumped out. The above notice was followed by similar notices in July and September following, and there was some evidence that in November 1886 the defendant was actually put out of possession. The plaintiff requested the Court to charge, inter alia, as follows: --(1) If the jury are satisfied from the evidence that work or operation ceased on the well for a period of three months or more, under the terms of the lease it became null and void and the plaintiff is entitled to recover. Answer. This is affirmed. (2) If the jury are satisfied that oil or gas in paying quantities was not pumped or excavated from this lease before the 27th of June, 1886, then the lease by its terms became null and void and the plaintiff is entitled to recover.
