About the Book

The aim of the inquiry was to establish the most appropriate means of maintaining the Assembly's Code of Conduct and handling alleged breaches in relation to it. The Committee has concluded that, broadly speaking, the principles of the existing system whereby the Northern Ireland Assembly regulates its own affairs and ultimately takes decisions on complaints that have been made against Members of the Assembly is an appropriate, reasonable and workable system. However, while these principles are sound there is important work that can and should be done in order to ensure that in practice the system is more robust, and is seen to be both fairer and more transparent. The most significant aspect of this is that the Assembly should have its own Commissioner for Standards whose role would be to carry out independent objective investigations into complaints against Members and to present his or her findings to the Committee. The role of the Assembly Commissioner for Standards should be set out on a statutory basis and should include the power to call for witnesses and documents. The Commissioner's independence from the Assembly in respect of specific investigations should also be set out in statute. There should be an open competition for the position of Assembly Commissioner for Standards which would enable the appointed Commissioner to take up his or her post as soon as possible after the start of the next mandate.
