Sharpe, for the executor of Dr. Rippon, contended that the deed affected that part of the stock only which was in existence at the time of its execution; and that the books printed after the date of the deed and in the lifetime of Dr. Eippon, were part of his personal estate. Mr. Tinncy, in reply. The Master Of The Rolls held that the effect of the deed was to declare a trust of a species of business, in which part of the property might be absolutely disposed of and new stock created in substitution; and that the books published after the date of the deed in the lifetime of Dr. Rippon, were therefore subject to the trusts of the deed. His Lordship also held that the plaintiffs, the three children, were entitled to three fourths, and the assignees to one fourth, of the profits which might accrue during John Rippon's life. Rippon V.
