Studienarbeit aus dem Jahr 2012 im Fachbereich Politik - Thema: Völkerrecht und Menschenrechte, Note: 2,0, Universität Hamburg, Sprache: Deutsch, Abstract: Der Eingriff der deutschen Bundeswehr unter dem Oberkommando der NATO in den Kosovokonflikt war der erste Kampfeinsatz einer deutschen Armee seit Ende des Zweiten Weltkrieges. Er war dementsprechend auch nicht unumstritten, zumal er in den Augen nicht weniger Betrachter gegen das Grundgesetz verstieß, in welchem geschrieben steht: "Handlungen, die geeignet sind und in der Absicht vorgenommen werden, das friedliche Zusammenleben der Völker zu stören, insbesondere die Führung eines Angriffskrieges vorzubereiten, sind verfassungswidrig. Sie sind unter Strafe zu stellen" (Grundgesetz, Art. 26, Abs.1). Erschwerend kam hinzu, dass für den militärischen Eingriff der NATO in den Kosovokonflikt kein Mandat der Vereinten Nationen vorlag, der Krieg somit einigen Beobachtern nicht nur als grundgesetzwidrig, sondern auch als unvereinbar mit Völkerrecht gewertet wurde. Auch nicht unproblematisch war der historische Hintergrund, da die deutsche Wehrmacht auf dem Balkan insbesondere gegen Serbien sehr gewaltsam vorgegangen war. Gleichwohl wurde der Eingriff der Bundesrepublik Deutschlands in den Kosovokonflikt begleitet von einem in Medien und Politik vorherrschenden Tenor, wonach der militärische Eingriff in den Kosovokonflikt eine humanitäre Aktion darstelle, die ausschließlich dem Schutz der kosovarischen Zivilbevölkerung diene, welche von ethnischen Säuberungen bedroht sei und einem Völkermord entgegen schauen müsse. So wird der damalige deutsche Außenminister Joschka Fischer zitiert mit den Worten: "Ich habe nicht nur gelernt: Nie wieder Krieg. Ich habe auch gelernt: Nie wieder Auschwitz".
