It concludes that such unilateral leave scheduling must be permissible when urgent operational needs require a certain leave period or when the leave entitlement would otherwise expire or have to be compensated financially. German description: Sowohl Betriebsferien als auch Urlaubsanordnungen innerhalb der Kundigungsfrist sind etablierte Instrumente in der deutschen arbeitsrechtlichen Praxis. Beides sind aber auch Arten der Urlaubsfestlegung, die erfordern, dass Urlaubszeitraume auch gegen den Willen des Arbeitnehmers festgesetzt werden konnen - und das obwohl 7 Abs. 1 S. 1 BUrlG die Berucksichtigung der Urlaubswunsche des Arbeitnehmers vorschreibt und die Moglichkeit, wegen dringender betrieblicher Belange hiervon abzuweichen, als blosses Leistungsverweigerungsrecht eingeordnet wird.Die Arbeit untersucht deshalb die Frage, ob und unter welchen Voraussetzungen Urlaub auch gegen den ausdrucklichen Wunsch des Arbeitnehmers festgelegt werden darf. Sie kommt zu dem Ergebnis, dass dies moglich ist, wenn dringende betriebliche Belange die Festlegung auf einen bestimmten Urlaubszeitraum erfordern oder wenn die Anordnung notwendig ist, um die tatsachliche Gewahrung des Urlaubs sicherzustellen. Die Arbeit erortert die Grenzen dieses Rechts und wendet die gewonnenen Erkenntnisse auf die Falle von Betriebsferien und Urlaubsanordnungen innerhalb der Kundigungsfrist an.
