Die Union ist eine selbstandige juristische Person unabhangig von den juristischen Personen, aus welchen sie besteht.--Uber die Fahigkeit, Mitglied einer assoeiation -ultuelle zu werden, gibt das Trennungsgesetz keine Vorschriften; aber eben darum sind dazu die weitesten Kreise berufen, so namentlich auch Frauen und zwar unverheiratete selbstandig, verheiratete mit Zustimmung ihres Mannes, ferner Minderjahrige mit Genehmigung ihres gesetzlichen Vertreters, soweit sie uberhaupt Mitglieder eines Vereins werden konnen, auch Auslander, und schliesslich konnen sogar die Geistlichen selbst Mitglieder werden, obwohl sie im Solde der Kultusvereine stehen. Dagegen konnen die Statuten bestimmen, dass Personen, die eintreten wollen, gewisse Bedingungen erfullt haben mussen, und dass Mitglieder unter gewissen Umstanden ausgeschlossen werden konnen, sie durfen aber nicht bestimmen, dass einem Mitglied der Austritt verweigert werden kann; niemand kann gezwungen werden, einem Kultusverein beizutreten oder anzugehoren. Aus alledem erkennen wir den Wunsch des Gesetzgebers, die juristischen Personen des Kirchenrechts im Gegensatz zum fruheren Prinzip so zu organisieren, dass die Verwaltung des Kirchenguts und uberhaupt die Reprasentation der Glaubensgesellschaften nicht mehr in der Hand einiger weniger Leute oder gar nur der Kultusdiener liege, sondern womoglich in der Hand samtlicher, in einem kirchlichen Bezirk wohnhafter Glaubensgenossen. Dieses Prinzip kommt auch praktisch zum Ausdruck bei den Organen, deren die Kultusvereine
