Excerpt: ... section 6 of that act, such fees were to be charged and collected and paid to the clerk of the court having jurisdiction, and by him covered into the treasury of the United States. 1376. (Act March 3, 1891, c. 517, 2, as amended, Act Feb. 19, 1897, c. 263.) Costs and fees in circuit courts of appeals. The costs and fees in each circuit court of appeals shall be fixed and established by said court in a table of fees, to be adopted within three months after the passage of this Act: Provided, That the costs and fees so fixed by any court of appeals shall not. with respect to any item, exceed the costs and fees now charged in the Supreme Court. (26 Stat. 826. 29 Stat. 536.) This provision was part of section 2 of the act to establish circuit courts of appeals, etc., cited above. The provision, as originally enacted, read: "The costs and fees in the 8upreme Court now provided for by law shall be costs and fees in the circuit courts of appeals." It was amended, to read as set forth here, by Act Feb. 19, 1897, c. 203, also cited above, and a further provision was added for a revision of the table of fees by the Supreme Court, which is set forth post, ( 1377. A further provision of this section, as originally enacted, that the coats and fees in said courts "shall be expended, accounted for, and paid for, and paid over to the Treasury Department of the United States in the same manner as is provided in respect of the costs and fees in the Supreme Court," may be regarded as superseded by provisions of subsequent acts, particularly those of Act Jatt/i 6, 1900, c. 791, 1, post, 1400. 1377.
