Not illustrated. 1890 Excerpt: ...that an assignment were made by such a person of his share of the trust estate, I by no means say that it would be impossible to extricate the Bank from the conflicting claims that might be made upon it in such a case. Probably the resources of the Court would be found extensive enough, by interpleader or otherwise, ultimately to relieve the Bank of England from the necessity of taking part in the proceedings; but before that point was reached there might be a troublesome and difficult investigation, and I do not see that the burden of such an investigation ought to be cast upon the Bank of England. I therefore do not feel at liberty to grant this mandamus. At the same time, what is proposed to be done by the plaintiffs in this case would seem to be highly convenient and a fair transaction, and I regret that there should be this technical difficulty in the way. While this technical difficulty exists the Court must give effect to it. It can only be removed by the intervention of the legislature. My judgment is, therefore, for the defendants, with costs.
